These Terms of Service ("Terms") constitute a legally binding agreement between you ("Guest," "you," or "your") and Casa Mañana ("we," "us," or "our") regarding your rental of the vacation property located in West Bay, Roatan, Honduras.
By making a reservation, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Booking and Reservations
1.1 Reservation Process
Reservations are confirmed only after:
- Receipt of a completed booking request through our website or direct communication
- Availability confirmation from Casa Mañana management
- Receipt of the required deposit or full payment
- Issuance of a written booking confirmation
1.2 Minimum Stay Requirements
- Standard season: 2-night minimum stay
- Peak season (December 15 - January 15, major holidays): 5-night minimum stay
- Special events: Minimum stay requirements may vary
1.3 Pricing and Fees
All rates are quoted in USD and subject to the following:
- Base nightly rate varies by season and length of stay
- Cleaning fee: One-time charge per stay
- Honduras Tourism Tax: Applied as required by local law
- All fees are disclosed before booking confirmation
2. Payment Terms
2.1 Payment Schedule
- Deposit: 50% of the total rental amount is required at the time of booking
- Final Payment: Remaining 50% due 30 days prior to check-in
- Bookings made less than 30 days before check-in: Full payment required immediately
2.2 Accepted Payment Methods
We accept payment via:
- PayPal
- Bank transfer (wire transfer)
- Credit card (through secure payment processor)
2.3 Currency
All prices are quoted and payable in United States Dollars (USD).
3. Cancellation and Refund Policy
Please refer to our detailed Cancellation and Refund Policy for complete information. Summary:
- 60+ days before check-in: Full refund minus $100 processing fee
- 30-59 days before check-in: 50% refund
- Less than 30 days before check-in: No refund
4. Check-In and Check-Out
4.1 Standard Times
- Check-in: 3:00 PM local time
- Check-out: 11:00 AM local time
4.2 Early Check-In / Late Check-Out
Early check-in or late check-out may be arranged subject to availability and may incur additional fees. Requests must be made at least 48 hours in advance.
4.3 Check-In Procedure
Detailed check-in instructions, including property access codes and directions, will be provided 48 hours prior to arrival. Guests must provide accurate arrival time to ensure smooth check-in.
5. Occupancy and Guest Requirements
5.1 Maximum Occupancy
Casa Mañana has a maximum occupancy of 8 guests. This limit is strictly enforced for safety and compliance reasons. Exceeding maximum occupancy may result in immediate termination of the rental agreement without refund.
5.1 Age Requirements
The primary guest must be at least 25 years of age. Valid government-issued photo identification is required at check-in.
5.3 Guest Registration
All guests must be registered at the time of booking. Only registered guests are permitted on the property.
6. House Rules and Property Care
6.1 General Conduct
Guests agree to:
- Treat the property and all furnishings with care and respect
- Comply with all local laws and regulations
- Respect neighbors and maintain reasonable noise levels, especially between 10:00 PM and 8:00 AM
- Not engage in any illegal activities on the property
- Not smoke inside the property (outdoor smoking areas are designated)
6.2 Prohibited Activities
The following are strictly prohibited:
- Parties or events without prior written approval
- Exceeding maximum occupancy limits
- Unauthorized pets (unless pre-approved in writing)
- Moving furniture or removing property items
- Use of the property for commercial purposes (including photography/filming without permission)
6.3 Pool and Outdoor Areas
- Pool use is at guests' own risk; no lifeguard is on duty
- Children must be supervised at all times around the pool
- No glass containers in pool area
- Pool hours: 7:00 AM - 10:00 PM
7. Damages and Security
7.1 Guest Responsibility
Guests are responsible for any damage to the property, furnishings, or equipment caused during their stay. This includes damage caused by guests' visitors.
7.2 Damage Reporting
Guests must immediately report any damage or maintenance issues to property management.
7.3 Damage Charges
Guests will be charged for:
- Repair or replacement of damaged items at current market value
- Excessive cleaning beyond normal wear (stains, spills, etc.)
- Missing items
- Smoking inside the property ($500 minimum fee)
8. Liability and Insurance
8.1 Limitation of Liability
Casa Mañana and its owners shall not be liable for:
- Personal injury or death
- Loss or damage to personal property
- Any indirect, incidental, or consequential damages
- Service interruptions (utilities, internet, etc.) due to circumstances beyond our control
- Weather conditions or natural events
8.2 Guest Insurance
We strongly recommend that guests obtain travel insurance covering trip cancellation, medical emergencies, and personal liability.
8.3 Assumption of Risk
Guests acknowledge that they use the property and its amenities (including the pool) at their own risk and agree to hold Casa Mañana harmless from any claims, injuries, or damages.
9. Force Majeure
Casa Mañana shall not be held liable for failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters (hurricanes, earthquakes, floods)
- Government restrictions or advisories
- War, terrorism, or civil unrest
- Pandemics or public health emergencies
- Utility failures
In such cases, we will work with guests to reschedule or provide alternative arrangements when possible.
10. Utilities and Amenities
10.1 Included Services
The following are included in your rental:
- Water
- Starlink high-speed WiFi internet
- Air conditioning (equipment; electricity usage is metered per Section 10.2)
- Pool maintenance
- Initial supply of towels and linens
10.2 Electricity (Metered)
Electricity is not included in the nightly rate. It is metered and billed at a flat $0.50 (USD) per kilowatt-hour for the guest's actual usage. The meter is read at check-in and at check-out, and the balance is payable at check-out. Typical usage runs $30–$60 per week depending on air-conditioning use. For comparison, approximate residential averages are about $0.17/kWh in the United States, $0.11 in Canada, and $0.31 in the United Kingdom — island power generation is simply far more expensive.
10.2 Service Interruptions
While we strive to maintain all services, occasional interruptions may occur due to local infrastructure or weather conditions. No refunds are provided for temporary service disruptions beyond our control.
11. Privacy and Data Protection
Your personal information is handled in accordance with our Privacy Policy. By booking, you consent to the collection and use of your information as described.
12. Modification of Property Description
While we make every effort to ensure accuracy, we reserve the right to make changes to property amenities, furnishings, or descriptions. We will notify guests of any significant changes that may affect their stay.
13. Right of Entry
Casa Mañana management reserves the right to enter the property:
- In case of emergency
- For scheduled maintenance or repairs (with advance notice when possible)
- To verify occupancy and ensure compliance with these Terms
14. Termination of Rental
We reserve the right to terminate the rental agreement immediately without refund if:
- Guest violates any terms of this agreement
- Guest exceeds maximum occupancy
- Guest engages in illegal activity
- Guest causes disturbance to neighbors or property damage
- Guest provides false information during booking
15. Communications
By booking, you consent to receive communications from Casa Mañana via:
- Phone/SMS/WhatsApp
- Messaging platforms
These communications may include booking confirmations, property information, and promotional offers (opt-out available).
16. Intellectual Property
All content on our website, including text, images, logos, and designs, is the property of Casa Mañana and protected by copyright laws. Unauthorized use is prohibited.
17. Disputes and Governing Law
17.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Honduras.
17.2 Dispute Resolution
Any disputes arising from these Terms or your stay shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts in Roatan, Honduras.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy and Cancellation Policy, constitute the entire agreement between you and Casa Mañana regarding your rental.
20. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated "Last Updated" date. Bookings made before changes take effect will be governed by the Terms in effect at the time of booking.
